Common Questions

Litigation FAQs

How long do I have to bring a personal injury claim?

In Northern Ireland, personal injury claims must generally be brought within three years of the date of the accident, or the date on which you first became aware (or should have become aware) that your injury was caused by another's negligence. There are exceptions for children and cases involving gradual onset conditions. Do not wait. Contact us as soon as possible to ensure your claim is protected.

What is the personal injury claims process?

The process typically begins with us sending a letter of claim to the party responsible (or their insurers). They have a set period to respond and investigate. Many cases settle at this pre-litigation stage. If not, formal court proceedings are issued. Even after proceedings, most cases settle before trial. We manage the entire process on your behalf and keep you fully informed at every stage.

Will I have to go to court?

Most personal injury and civil litigation cases settle before they reach a full trial. However, if the defendant refuses to make a reasonable offer, or contests liability, we may need to issue proceedings and potentially proceed to a hearing. We will always advise you on the pros and cons of accepting any settlement offer versus proceeding to trial, so you can make an informed decision.

What if my injury was caused by a road traffic accident?

Road traffic accident claims are handled through the Motor Insurers' Bureau (MIB) if the other driver was uninsured or untraced, or directly against the other driver's insurer if they were insured. We have experience of all types of road traffic accident claims, from minor whiplash to catastrophic injury, and will pursue your claim fully whatever the circumstances.

How much could my claim be worth?

The value of a personal injury claim depends on the nature and severity of your injury, its impact on your life and livelihood, any financial losses you have suffered (including future losses), and the applicable case law. We will give you an honest assessment of value once we have reviewed your medical evidence and the full circumstances of your case. We do not speculate on figures before we have all the relevant information.
