Do I need a solicitor to set up a company?
While it is technically possible to register a company without a solicitor, taking professional legal advice at the outset protects you significantly. We can advise on the most appropriate business structure (limited company, partnership, sole trader etc.), draft shareholders' agreements and articles of association, and ensure you understand the legal obligations that come with running a company. Getting the structure right from the start avoids costly problems later.
How does debt recovery through the courts work?
If a debtor will not pay despite demand letters, legal proceedings can be initiated in the Magistrates' Court (for smaller amounts) or the County Court or High Court (for larger sums). We will draft and serve the proceedings, manage any defence or counterclaim, and pursue enforcement of any judgment obtained. This includes attachment of earnings, charging orders, and other mechanisms. Our Director Ronan McGuigan has significant expertise in debt litigation across all court levels.
What should I look out for in a commercial lease?
Commercial leases are complex and the terms can significantly affect your business over many years. Key areas to scrutinise include the rent review provisions, break clauses, permitted use, repair and reinstatement obligations (dilapidations), assignment and subletting rights, and the landlord's right of entry. We review commercial leases thoroughly, advise on the risks, and negotiate better terms where possible before you commit.
When is the right time to take legal advice for my business?
The right time is before you need it. The most expensive legal problems are those that could have been prevented by early advice. These include a poorly drafted contract, an ill-considered business purchase, or a partnership without a written agreement.
